Yes as it is the upper that is the controlled piece.

I second that. On most guns, the lower receiver is the restricted part and you can import uppers are necessary. But on the MP5 (and a few other guns), the upper is that's restricted. So yeah, you'll most likely end up receiving a letter from customs telling you the part's been seized.
